Privacy v. Good Faith

Anyone want to talk about the United States v. Maher case?—it’s a big one if you care about digital privacy. The case centers on the Fourth Amendment, which is our constitutional shield against unreasonable searches and seizures, and it has huge implications for how law enforcement accesses our online content when flagged by companies like Google.

Ryan Maher uploaded a file to his Google account, and Google’s algorithm flagged it for child pornography through something called “hash matching.” Hash matching is where a computer algorithm checks if a file matches any known illegal files based on their unique digital “fingerprint.” Google didn’t look inside the file visually; it just found a match. Google then reported this to the National Center for Missing and Exploited Children (NCMEC), who sent it to law enforcement. Instead of getting a warrant to open Maher’s file, the police just opened it up and took a look. This visual examination of the file is where Maher’s defense comes in, arguing that his Fourth Amendment rights were violated because the police overstepped by not getting a warrant.

The core of the Fourth Amendment is about keeping the government from snooping without just cause. Maher argued that because he had a reasonable expectation of privacy in his files, police had no right to go beyond what Google’s algorithm saw without a warrant. And the court agreed with him, to a point.

It’s complicated. The court acknowledged that law enforcement had overstepped by looking inside the file without a warrant. However, they still upheld Maher’s conviction. Why? The “good faith exception.” This exception basically says if law enforcement was acting on what they genuinely believed to be legal grounds at the time, then the evidence doesn’t get thrown out. The court said that the officers thought they were okay to look at the file, especially given how new and ambiguous the rules are around digital hash-matching and privacy.

I get the need to prevent horrific crimes and stop criminals. This ruling basically says, “We might have violated your rights, but we did it with good intentions, so it’s fine.” That sets a precedent, and not a particularly comfortable one if you’re someone who believes in strict boundaries when it comes to government overreach.

Imagine you have your personal or work data in cloud storage (odds are, you do)—files that could be hash-matched and flagged by a private company. If a company like Google can flag your file without looking inside, and then police can take that flag and use it as an open invitation to dig deeper without any further oversight, that’s not exactly reassuring for those of us who deal with sensitive data. It blurs the line between what’s truly private and what’s fair game for the government.

This case shows the need for clear rules about where Google’s private searches end and where the government’s ability to search begins. Just because a file has a matching hash doesn’t mean it’s an open door to bypass the Fourth Amendment. Right now, it’s a bit of a gray area, and gray areas in the law often lead to rights slipping through the cracks.

While tools like hash-matching are valuable for catching criminals especially involving SA/CP crimes, they can’t be an excuse to forget the protections that were put in place long before anyone even thought about cloud storage.

Tech companies, like Google, are on the front lines of the digital privacy debate, and clearer policies—especially around hashing and the steps they take after a file is flagged—could help users understand where their privacy rights stand. If companies openly communicate about what’s done with user content, and if law enforcement operates within clear warrant requirements, it could help ensure rights are protected, while also ensuring the safety of children are paramount.
